1. INTRODUCTION

1.1 These TERMS AND CONDITIONS govern your relationship with Young Jamieson Fine Art (YJFA) and apply to all quotations, offers, orders and contracts for sale of Artwork by Young Jamieson Fine Art to you, the Buyer.

1.2 In these Terms and Conditions, unless otherwise stated:

BUYER – means the purchaser of Artworks from Young Jamieson Fine Art

YOUNG JAMIESON FINE ART – will be referred to from now on as YJFA

  1. AVAILABILITY AND PRICING

2.1 All artworks are sold subject to availability.

2.2 YJFA will inform you as soon as possible if the goods you have ordered are no longer available.

2.3 All prices are subject to change without notification.  If any price is different from that quoted by YJFA we will inform you before the final transaction and you will have the option of canceling your purchase.

2.4 The purchase price shall be the price offered by YJFA and confirmed to the Buyer by written invoice.

2.5 The purchase price does not include delivery unless otherwise agreed in advance.

  1. ORDER

3.1 Any offer or acceptance of a quotation made by the Buyer will be deemed an offer to purchase the artwork.

3.2 No offer or acceptance of a quotation will be deemed a binding agreement of sale until an invoice has been issued by YJFA and full payment has been made.

3.3 The Buyer will have 7 working days from the date of invoice to make payment in full unless agreed otherwise.  

3.4 To secure the artwork a 10% deposit must be paid.  This will ensure that the artwork is removed from sale for 7 days.  After this period the deposit is non-refundable and will be held as a credit towards your next purchase.  The artwork will be re-released for sale.

3.5 All payments shall be made in British Pounds Sterling.  YJFA does not accept any other currency unless otherwise agreed beforehand.

3.6 Artworks will not be released until full payment has been made.  YJFA does offer a Finance plan and goods can be released to the Buyer once the application has been approved – LINK TO FINANCE

  1. OWNERSHIP

4.1 Ownership (legal title) of the artwork will not pass to the Buyer until the accepted and the confirmed price is paid in full and received by YJFA in cleared funds.

  1. COLLECTION/STORAGE

5.1 Artwork purchased and paid for in full must be collected from the gallery within 7 days unless agreed otherwise.  If the work remains uncollected after this time the piece will be moved into storage.

5.2 YJFA can organise the delivery of the artwork to the Buyer.  Delivery charges will be quoted and shipping options and delivery times given.  

5.3 All artworks will be packed securely and sent using one of our specialist courier companies.  

5.4 Standard shipping options cover loss and damage to artworks in transit.  All artworks are covered by either YJFA or the Courier company whilst in transit.

5.5 YJFA will make its best effort to deliver the artwork by the agreed date or within a reasonable time if no dates are stated.  All delivery dates are estimates only and YJFA will not accept responsibility for goods being delayed as a result of the Shippers.

5.6 YJFA is not responsible for the payment of any import or customs duties that may be payable on artwork purchased.

5.7 The Buyer must inspect the artwork upon delivery and advise YJFA of any defects to the artwork or frame immediately.

5.8 Risk of loss or damage to the artwork passes to the Buyer upon delivery.

  1. REFUNDS

6.1 It is the responsibility of the Buyer to thoroughly inspect the artwork on delivery.  Upon receipt of the artwork, the Buyer must raise any queries or complaints about the artwork immediately. If YJFA hears no complaints or issues from the Buyer on the day of delivery then YJFA will assume that the artwork has arrived in perfect condition and the Buyer is happy with their purchase.

6.2 If the artwork is damaged in transit then YJFA will be responsible for making amends to the artwork and returning it to the Buyer as soon as possible.

6.3 No refunds are given on artwork once the Buyer has received the artwork and is happy with the condition.

  1. DATA PROTECTION

7.1 YJFA will hold any personal information provided to it in confidence and in accordance with the Data Protection Act and other applicable data protection legislation.  

7.2 All confidential information, including credit card details, are held securely and only transmitted in encrypted form.  

7.3 YJFA will use personal information for the administration and servicing of the Buyer’s purchase and all other related activities. Customer details are not passed to third parties and are used only in accordance with the Data Protection Act.

8.2 Neither YJFA nor any third parties provide any warranty or guarantees to the accuracy, timelines, performance or suitability of the information and materials found or offered on this website for any particular purpose.

Goods are normally dispatched within 7 days. If we are unable to despatch your order within 14 days, we will contact you by e-mail with an estimated despatch date and offer you the option of cancelling the order.

Please be aware that some sculptural pieces will be subject to a 3 month delay as they are made to order, this may also apply to some other works listed on this site, If this is the case we will contact you to let you know when we expect the piece will be ready for shipping.

Courier companies will vary depending on the works ordered; once an order is placed we will contact you to inform you of all relevant details for delivery.
